New rules announced to provide better protection for NHS whistleblowers
New rules are being introduced that prohibit discrimination against NHS whistleblowers if they seek re-employment in the health service.
Plans have been published for new regulations devised in response to Sir Robert Francis' Freedom to Speak Up review, which indicated that many people struggle to find employment in the NHS after making protected disclosures about patient safety.
The proposals will also strengthen the legal recourse available to whistleblowers if they believe they have been discriminated against because they appear to have blown the whistle, with remedies in place if their complaint is upheld.
Applicants will have a right to complain to an employment tribunal if they have been discriminated against, with compensation potentially due, as well as the possibility of bringing claims to a county court or the High Court.
Health secretary Jeremy Hunt said: "Today we move another step closer to creating a culture of openness in the NHS, where people who have the courage to speak up about patient safety concerns are listened to, not vilified."
These draft regulations will now be subject to a consultation period, which will last until May 12th.
