Sanofi-aventis appeal upheld

Sanofi-aventis has announced that its appeal against the decision by a US District Court regarding a patent infringement has been successful.

The company said that the Lovenox patent infringement case against Amphastar and Teva will now be heard again in a US District Court following the US Court of Appeal for the Federal Circuit decision to uphold the company’s appeal.

The appeal, filed in August last year, was disputing the decision by the District Court that the sanofi-aventis patent was unenforceable in the case against Teva and Amphastar.

In a statement, the company made clear its feelings on the decision and the future developments of the case.

“Sanofi-aventis welcomes this ruling and will continue to vigorously defend its intellectual property rights before the District Court.

“Sanofi-aventis believes that the proposed manufacture, marketing or sale of the defendants’ generic enoxaparin sodiums would infringe its US intellectual property rights.”

The company also said that the case would now proceed concerning the infringement, validity and enforceability of the company’s patent for Lovenox.
