Boston Scientific wins one patent battle, loses another
Boston Scientific has been found guilty of both breaching stent patent and being a victim of another manufacturer’s infringement.
A district court in Delaware in the US has ruled that Boston Scientific has infringed stent patents on two of Johnson and Johnson company Cordis’ own products – the Palmaz balloon extendable stents and the Gray patent on flexible balloon extendable stents.
The jury found that Express and Taxus Express infringed one Cordis patent and that Liberte was in breach of a second. The decision upholds a previous ruling.
Commenting on the decision, Rick Anderson, company group chairman at Johnson and Johnson, said: “We are pleased with today’s decision from Judge Robinson to uphold the jury verdict in favor of the Palmaz and Gray patents.”
However, the company has also highlighted that a separate jury found that Johnson and Johnson breached a Boston Scientific stent patent through its BX Velocity and Cypher products.
In related news, Boston Scientific recently announced is suing Conor Medsystems for patent infringement and has also recently won a case in the Netherlands against Sahajanand Medical Technologies’ Infinnium for infringing paclitaxel-eluting stents.
