Bayer Schering Pharma files patent lawsuit against Teva

Bayer Schering Pharma has filed a patent infringement lawsuit against Teva Pharmaceuticals.

The company – along with Bayer Healthcare Pharmaceuticals and Schering Corporation ? has made the claim to the federal court in the district of Delaware.

It concerns a marketing authorisation application that Teva has submitted to the Food and Drug Administration.

Prior to patent expiration, the paperwork was for a generic version of Levitra, which is Bayer Schering Pharma’s medication for erectile dysfunction (ED).

In March this year, Bayer Schering Pharma discussed data that showed the drug could significantly improve the problem.

Even men with underlying medical conditions could maintain an erection for between two and three times longer by taking the therapy, compared to without.

Dr Matt Rosenberg was the principal investigator during one of the clinical trials of the therapy and commented: “Duration of erection can be considered an innovative and meaningful efficacy parameter indicating patient?s satisfaction with treatment of ED.”
